Mack, 49, was coerced into ending his trial in 2007 and entering pleas, his lawyer, William Routsis, said in a court document.
And Mack’s previous lawyers failed to tell him that if he continued with the trial, the jury might have convicted him of a crime carrying a lighter sentence than murder, so his plea was unconstitutional, Routsis said.
But Special Prosecutor Christopher Lalli is scheduled to argue that Mack’s case was hopeless and he was wise to stop his trial after the prosecution finished calling witnesses.

Harry Reid has some competition from the other party for the U.S. Senate race:
Sue Lowden of Las Vegas officially filed to run in the Republican U.S. Senate primary election Monday afternoon in Carson City at the Secretary of State’s office.
Earlier, Sharron Angle of Reno filed to also run in the Republican U.S. Senate primary and Brian Sandoval of Reno filed to run for governor as a Republican.
They are two among several candidates for the GOP nomination.
