The Truth

Accused killers have far more rights than any teacher in the United States of America. Teachers' rights are almost non-existent because administrative law is not taken seriously by school districts or by the real legal system.

By the time you know the truth about your "rights" as a teacher, it is too late. The legal system is heavily rigged in the districts' favor. Administrators get away with murder with their bogus allegations against teachers, while teachers' lives are ruined.

Furthermore, in either a normal civil or criminal action those bringing charges or seeking any form of legal action must state a claim upon which relief can be granted, which requires evidence. Evidence is the verified/sworn statement of those making it that what they say is true. The reason it is made under penalty of perjury, which is a felony if false, is to dissuade people from being intimidated by their principal into bearing false witness against another teacher for fear of not bringing the wrath of the principal on themselves for failure to comply. At LAUSD, the imagination is the only limit to the charges they cook up to get rid of teachers, since perjury is not an impediment, because none of the charges they bring against any targeted teacher are verified, under oath, and under penalty of perjury.

All this is bad enough, but what drives most teachers nuts is their failure to understand that LAUSD and their partners at UTLA don't have to have any real charges to get rid of you. All they have to do is starve you out, since from the time you are put on unpaid administrative leave, most teachers start to hemorrhage savings trying to keep their head above water long enough to vindicate their rights.

That applies to every single school district in the United States. It is not unique to LAUSD. I had absolutely no real charges against me but an idiot principal who didn't follow the law and took orders from a crook from human resources who refused to follow the law himself. I was railroaded out of a career and economically destroyed while these assholes are still ripping off Washoe County taxpayers with their make-work jobs (not the jobs they had when I was canned).

The ONLY way I believe teachers being forced out of WCSD ever got reinstated was when and if they had outside attorneys. My view is the district believed that if teachers had the finances to hire an outside lawyer, there was a distinct possibility the teacher would sue. Unless there were real charges of wrongdoing against a teacher, the district would simply back down and allow reinstatement of a teacher. However, if a teacher used NSEA's law firm of Dyer Lawrence, the district could simply cut deals with it and WEA to ruin teachers. The district's administrators could be arrogant assholes and rig hearings KNOWING the poor teacher could NOT sue in court.

It's a hell of a note that the only way you are sure to keep your career as a teacher unless you really do something criminal is to have a lawyer on retainer. What single teacher in this country has the 5k or 10k to keep one available?
