The state attorney's office says it has charged suspect him with homicide because the child died in infancy. Prosecutors say experts believe the infant might have survived if Fritzl had arranged for proper medical care.
The child was eventually burnt in an incinerator.
The 73-year-old retired electrician has also been charged with rape, incest, false imprisonment and slavery and his trial is expected to begin early in 2009.
