I suspect the California Supreme Court will uphold Proposition 8 because it IS a constitutional amendment, and if it is to be overturned, there has to be another initiative to do so. I can imagine the horrible precident set if the court did overturn it. I believe there would be an immediate move to recall the justices.
I could be wrong and there is a chance they will overrule it, but I doubt it.
What will likely happen is those same-sex marriages which took place during the time period between the court ruling last year and the November election will remain valid. I believe this is the main sticking point in the whole saga. These couples are in limbo.
