It looks like former superintendent Pedro Martinez won't be out of a job for very long, as Nevada governor Brian Sandoval has appointed him to be a superintendent of something called the Achievement School District.
It is supposed to oversee or something schools that are struggling to make it under impossible directives.
Of course it won't work because Nevada has a large transient population.

He should start up a non-profit with other members of the community to help disadvantaged youth.

Somebody sent me a comment yesterday about how to get in touch with recall efforts on the Board of Trustees. I would do a Google search on that; I cannot at this time remember who is spearheading it. As I recall, there were two separate recall campaigns against the offending Board members.

Remember, Washoe County School District "Won" After All
The important thing to remember from this is that the district "won." They got "rid" of Pedro Martinez. It didn't matter how illegal it was since they had Judge Hardy in their pocket to recommend a "do-over" despite the blatant conflict of interest. It didn't matter how much it cost since it isn't "their" (the Board members') money that's involved. It didn't matter what the public thought about the whole matter. The important thing is that he is "gone" just as their district lawyer advised them that they could indeed flout the law. The end always justifies the means with that district despite its perverting the purpose of the legal system. The all-important "gag clause" is in that agreement so that the district can pull the same garbage on other employees that they did on Martinez by silencing him and the Board from discussing the matter further.

Washoe County School District Will Always Be a Toxic Dump
Who in the hell is going to want to work for that dump after the way the Board of Trustees treated Pedro Martinez? The mediation judge has decided to recommend Pedro Martinez's contract be enforced and to pay him separation pay and attorney fees. I am guessing the amount will be in excess of $400,000.
It will have to be up to the voters to decide what happens to their idiotic board.
The big question will be who will they find to take over the job. Hell, I wouldn't be surprised they pick some lifer like Paul Dugan who had a low I.Q. and wouldn't do one damned thing to administrators who screw up.
Nobody will want the job until that board is gone.

Of Course He Was Going to Turn Down the Offer
That ridiculously low amount was a pure political ploy that was designed to guarantee Martinez would turn it down. Then the public would be upset and call Martinez "greedy" when it was the BOARD that was entirely at fault.
Yes, it's going to cost money, mostly likely covered by the district's insurance carriers, but the right to due process, including the right to sue, is part of the American legal system. Martinez's rights were trampled upon. There is no question of it.

Washoe County School District Gossip: The End?
Next week both sides in the Pedro Martinez lawsuit against the district and the Board of Trustees will be going to mediation to try and settle the embarrassing episode.
The district is offering a piddling $25,000. I wouldn't be surprised if Martinez takes the deal although it may smell of a trap.

He Has the Right to Due Process
I can't believe anybody could write such a poorly reasoned letter as this one. Pedro Martinez was wrongfully terminated, and he has the right to due process as any other individual in the United States. He's luckier than most people wrongfully terminated by school districts in that he has the access to legal representation. Many of us who were illegally dumped by this district weren't even told of our rights by our alleged "unions," groups that are actually subsidiaries of the school district. We didn't get to exercise our rights at all.
Where does this "million dollars" come from, by the way? I didn't see any such thing being asked by Martinez in his original complaint. He was asking for a "minimum of $10,000." Oh, that's right, it was the DISTRICT'S outside lawyer who came up with that figure. Just like everything else this district does--pulls out stuff literally out of its backside in trying to cover up for their wrongdoing. Even if he asked for that much, it's his right to have due process.

Some Nevada pols are talking about the legislative "void" resulting from the Martinez sacking.
Of course Pedro Martinez is not the problem here. The problem is with a corrupt board in bed with the corrupt good-old-boy system that actually runs the district. Martinez upset the applecart with the Mieras flap, but even before when he talked about how difficult it was to fire principals, which is the truth. These entitled idiots who think they deserve lifetime jobs because of their connections didn't like the dirty truth coming out, so they retaliated. That's my theory, and it's probably as close to the real story as possible.
I KNOW Martinez is telling the truth because I went through almost the identical thing. What he alleges in his suits is also the ENTIRE story, at least regarding the events leading up to his being sacked. It sounds unbelievable, but rest assured it is the truth. We don't know who or what put the board up to breaking the law. That's the only mystery, and the truth of that may never come out. The district really does force people out on bogus charges or twists the facts in order to get the unwanted person out. The goal is to get the person out by any means short of bodily harm.
They are going to lie and rig the legal process for their benefit because the goal is protect the people responsible for ruining an innocent but unwanted person in the district. The lawyers, graduates from Shyster U., say administrators or the board don't have to follow the law or honor employment contracts. Now that's a new one, but the district believes this because it isn't their money that's involved. They figure, get the person out, and lotsa luck finding an attorney who is licensed in Nevada who will take your case. It's nearly impossible for the average person. Martinez could do it, but I couldn't.
Every single member of the Board who was involved in this needs to be recalled or forced to resign. Every person who runs for the school board should be required to disclose ALL potential conflicts of interest including previous employment at WCSD, relatives who work at WCSD past and any other relationships (as employees, neighbors, etc.)
Anybody who has ever worked there as an administrator should be automatically disqualified from running for the school board. Just too many potential conflicts of interest since they sign off on both hirings and terminations.

Martinez — Washoe's first Latino superintendent — would have had the institutional knowledge and experience to fight for some of that money earmarked for English-language-learners' programs.

I was under the impression the AG was already investigating, but the RGJ is on the record now with such a request.

The Confederacy of Dunces violated both, and Martinez will win big, either through a settlement or a judgment. Not that the board cares because it isn't their money at stake except for perhaps the $500 (per board member) slap-on-the-wrist sanctions for violating the OML.

This could wind up costing the district hundreds of thousands of dollars, if not in the millions. I hope Martinez drags the district through the courts, and then the public will see what the district REALLY is about.

I have been retained by Pedro Martinez to represent him in seeking equitable relief and
damages for the wrongful termination of his employment as Superintendent of the Washoe
County School District and related claims. The District and its Trustees have violated both Nevada law and the employment agreement with Mr. Martinez. The purpose of this letter is to put you, the District and the Board of Trustees on notice of his claims so that you will take all actions required by you under the law of this state, and your professional responsibility, to protect and preserve all discoverable evidence relating to this matter. As you know, even when an action has not yet been commenced. a party with notice of a potential legal claim has a duty to protect and preserve all evidence which it knows or reasonably should know may be relevant to the potential action. See Fire Insurance Exchange v Zenith Radio C’orp., 103 Nev. 648, 747 P. 2d
